By accessing or using our app, website, or any other way of interacting with Lola’s services (collectively, “Our App”), you agree to these Terms and our Privacy Policy.

Definitions

“Lola,” “we,” “us,” or “our” refers to Lola Agent, LLC.

“Member,” “you,” or “your” refers to any person who accesses or uses Our App, whether or not they create an account.

“Service Providers” are third parties offering travel and related services, such as hotels, rental cars, flights, restaurants, events, and activities.

Changes to These Terms

We may update these Terms at any time by posting a revised version in Our App. Your continued use of the platform after changes are posted means you accept the updated Terms.

Membership & Accounts

You become a Member the moment you access or use Our App. You must be at least 18 years of age and possess the legal authority to form binding contracts. You are solely responsible for all activity on your account and for keeping your information accurate. Lola reserves the right to terminate or suspend your account at any time for any breach of these Terms.

Termination

Lola reserves the right, in its sole discretion, to terminate or suspend your account and access to Our App at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms, suspected fraudulent activity, or improper chargebacks.

Our Role

Lola is a discovery, recommendation, and reservation platform for travel and related services.

Third-Party Ownership

Lola does not own, manage, or control Service Providers.

Direct Contracting

When you book a service, you contract directly with the Service Provider.

Provider Terms

The Service Provider’s specific terms and conditions apply to your booking; Lola is not responsible for the performance or quality of their services.

Bookings & Reservations

Request vs Confirmation

Reservations may be instant or request-based; a booking is only confirmed once finalized by the Service Provider.

Changes

Service Providers may change or cancel reservations.

Payments, Fees & Refunds

Merchant of Record

Service Providers are typically the merchant of record for transactions.

Fees

Additional fees, such as provider fees, taxes, and platform fees, may apply to your bookings as determined by Service Providers.

Refunds

All refund requests and cancellation policies are set by the Service Provider. Lola does not guarantee refunds.

Chargebacks & Fraud

Improper chargebacks may result in suspension and recovery of costs incurred by Lola.

Use of Our App

You agree not to misuse the platform, for fraud, scraping data, or any unlawful activity.

Content

You are responsible for any content you post. By posting, you grant Lola a non-exclusive license to use that content.

Intellectual Property

All content, features, and functionality on Our App, including but not limited to the "Lola" name, logos, software, text, graphics, and proprietary algorithms, are the exclusive property of Lola Agent, LLC and are protected by copyright, trademark, and other intellectual property laws. Your use of Our App grants you no right, title, or interest in our intellectual property except for the limited right to access the services as intended.

Limitation of Liability & Disclaimers

Services are provided “as is” and “as available”. Lola is not liable for issues caused by Service Providers, indirect damages, or events outside our control (Force Majeure). Local laws may provide you with additional rights that these Terms cannot override.

AI & Data Use

Our App utilizes artificial intelligence to provide recommendations and travel information. You acknowledge that AI-generated content may occasionally be inaccurate, incomplete, or "hallucinate" details such as [pricing, availability, or travel requirements]. You are solely responsible for independently verifying all critical information with the relevant Service Provider before booking or traveling. Lola is not liable for any damages resulting from reliance on inaccurate AI-generated content.

Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The seat of arbitration shall be Hartford, Connecticut. The arbitration shall be conducted in English.

Governing Law

These terms are governed by the laws of Connecticut.
